lets just say the gun is empty at the time and he is getting used to the feel. I don't see anything shooting out of it so lets just go with that and say he is off the hook :D

I don't know.  For safety purposes I would suggest at all times wear them when firing them.  Do I, no.  But at a field I always try.  My point is that you never know what might happen.
